Write of Elections for General Elections 2015 :

The Elections and Boundaries Commission (the Commission) wishes to clarify the matter of the issue of the Writs of Election for the General Election to be held on 7th September this year.

By letter dated 17th June 2015 from Her Excellency Raziah Ahmed, Acting President of the Republic of Trinidad and Tobago to the Honourable Kamla Persad-Bissessar, Prime Minister, which was copied to the Chairman of the Elections and Boundaries Commission and received by him on 24th June 2015, polling date and the date of nomination day for the General Election arising from the dissolution of Parliament on 17th June 2015, were appointed to be, respectively 7th September, 2015; and 17th August, 2015.

Paragraph 3 of this correspondence is hereby quoted verbatim: “The Chairman Elections and Boundaries Commission will be immediately requested to prepare the Writs of Election.”

At a meeting of the Commission held on 25th June 2015, the day following his receipt of copy of the letter from the Acting President, the contents of the letter were discussed and it was agreed that the Chairman should write at once to His Excellency the President informing him that the Commission is currently in the process of selecting, training and appointing the forty-one Returning Officers required for the election and that as soon as that exercise is completed, the necessary Writs of Election shall be forwarded to His Excellency.

The Chairman’s letter dated 26th June 2015 ended in the following terms:
“The opportunity is now taken to draw to Your Excellency’s attention the fact that in accordance with Clause 33(3) of the Representation of the People Act, Chapter 2:01, the latest date for the issuance of the relevant Writs of Election by Your Excellency is 3rd August, 2015. For ease of reference the said Clause (33(3) is quoted hereunder:

Every writ of election shall be in the form set out as Form No. 2 in the Prescribed Forms Rules and shall specify :
(a) the day of the nomination of candidates, being not less than fourteen days after the day of issue of the writ;
(b) the day upon which, if necessary, the poll shall be taken, being not less than twenty-one days after nomination day;
(c) the day the writ is returnable to the Commission.”

The Commission proposes to act in accordance with the information given to His Excellency the President.
